Court Rules Chinese Men Aren't Entitled To Come Here Just Because Their Wives Had An Abortion

Chinese men aren't entitled to asylum in the U.S. just because China's strict one-child only policy forced their wives to have an abortion.

But the women who had the abortions are welcome.

The case started when Xian Tong Dong came to the U.S. about six years ago after his wife was forced to have an abortion, claiming the dad feels just as much pain as the mom does, The Wall Street Journal's Law Blog reported Wednesday.

But the First Circuit Court of Appeals wasn't buying it.

Judges acknowledged Dong's arguments held a "certain superficial appeal," but they and four other courts ruled that husbands can't be granted asylum under such circumstances.

China's Golden Week Is Going Spectacularly Well, But...

All you have to do is look at photos of China's traffic jams to know that Golden Week has been busy for the world's second largest economy.

Golden Week is a period of holidays during which Chinese people find themselves travel and spend much more than usual.

Early data confirms this year's Golden Week is much more active than last year's.  From Bank of America's Ting Lu:

China's 1.3bn consumers are being closely watched this week amid escalating worries about China's hard landing. To be sure, this year, we led the Street in cutting China's GDP growth forecasts and we don't expect a strong turnaround soon, but we believe worries about a hard landing are overdone in the market now. Strong tourism data (the number of tourists is up 23.4% yoy) for the first four days of the 8-day-long National Day Golden Week (from 30 Sep to 7 Oct) lends support to our soft-landing views.

"Tourism data also point to a shift of consumption toward leisure, a new source of demand," writes Lu.

However, he warns that there are two things that may be giving this year's Golden Week an extra boost.

  • "First, this year, the Mid-Autumn Festival was the first day of the Golden Week Holiday, while last year, the Mid-Autumn Festival was three weeks ahead of the Gold Week."
  • "Second, tourist data could be distorted upward this year by a new policy that cancelled fees for highways during Golden Week for the first time."

Nevertheless, Lu notes that these two factors aren't having a huge impact.  Rather, the strong data is a reflection of resilient consumer confidence in China.

NEW YORK (AP) ? Americans may have slowed their spending in September after splurging during the start of the busy back-to-school shopping season in the month before. But most importantly, they were still spending.

September sales rose 3.9 percent ? a slowdown from the 6-percent rise in August ? as 22 retailers like Macy's (NYSE: M) and Costco (Nasdaq: COST) reported mixed results, according to the International Council of Shopping Centers. Still, given the economic and political uncertainty that weighs on many Americans right now, analysts say the results are an encouraging sign for stores as they head into what's traditionally the busiest shopping period of the year in November and December.

"This should set up to be a good holiday season," said Ken Perkins, president of Retail Metrics LLC, a research firm.

Retailers' monthly sales figures are based on revenue at stores opened at least a year. That measure, which is considered to be an indicator of a retailer's health because it excludes results from stores recently opened or closed, offers insights into how Americans are spending during the slow economic recovery.

But only a handful of merchants representing about 13 percent of the $2.4 trillion U.S. retail industry report monthly revenue. And that list is dwindling: Target (NYSE: TGT) on Thursday said that it will no longer report monthly figures starting next year.

Target was among those retailers reporting results that fell short of analyst expectations. The discounter said its sales gain of 2.1 percent was slightly below analysts' expectations as shoppers picked up back-to-school items and groceries. Department-store chain Macy's also posted a 2.5 percent increase last month that was below the gain of 3.3 percent analysts polled by Thomson Reuters had expected. Meanwhile, Costco Wholesale's 5.7 percent gain put it among the merchants that posted results that beat Wall Street estimates.

September's results offer hope for retailers as they head into the winter holiday shopping season, a two-month period in which they can make up to 40 percent of their annual revenue. It's the latest sign that consumers are feeling a little better about the economy. That's important because consumer spending accounts for 70 percent of economic activity.

Right now, confidence is at a seven-month high as people are feeling better about rising home prices and a rebounding stock market. Still, job growth remains weak and prices for everything from food to gas are higher. On top of that, there's a worry that the U.S. economy will fall into another recession next year. That's when tax increases and deep government spending cuts will take effect unless Congress reaches a budget deal.

"If (Congress) can get their act together, it will be good for the consumer's psyche," said Michael P. Niemira, chief economist at International Council of Shopping Centers, an industry trade group. "If they don't, I think you could see problems. It could affect high-end spenders and the general confidence on the economy."

Mary Mastenbrook, a 58-year-old who lives in Schaumberg, Ill., says she will be closely watching how the budget battle plays out. She bought a flat-screen TV last month at Abt Electronics, but she's not sure how much she will be spending for the winter holidays.

"If things are not clear, we are going to temper what we're going to spend," a homemaker whose husband is a defense contractor. "You can't spend a lot if you don't know whether your job is secure."

Because of economic and political uncertainty, The National Retail Federation, the nation's largest retail trade group, has tempered its expectations for the winter holidays. The group said this week that it expects sales for the November and December period to rise 4.1 percent.

That's more than a percentage point lower than the growth in each of the past years and the smallest increase since 2009 when sales were up just 0.3 percent. But the forecast still is higher than the 3.5 percent average over the past 10 years.

This Supreme Court Justice Keeps Saying He's Just Like Frodo

Elijah Wood as Frodo in Lord of the RingsSupreme Court Justice Antonin Scalia compared himself to Frodo Baggins in "Lord of the Rings" yet again during a speech Tuesday,  Washington Examiner's Jenny Rogers reports.

"I feel like I'm Frodo in 'Lord of the Rings,'" Scalia said at an event held by the right-leaning American Enterprise Institute. "The evil eye will get us sooner or later, but it's worth the fight."

This was not the first time the outspoken justice has compared himself and other Constitutional originalists to the curly-haired, elfin character immortalized by Elijah Wood.

In "Lord of the Rings: Fellowship of the Ring," Frodo receives a ring filled with evil, which puts him at the "center of a struggle for the future of the world," according to this New York Times review.

Scalia's Frodo comparisons suggest he views himself as an underdog hero, even though he serves on a largely conservative court.

Just last month, Scalia dropped Frodo's name at the New York City Lawyers Chapter of another right-leaning group, The Federalist Society, Above the Law reported at the time.

Scalia said he and other orignalists were fighting a noble battle against tough odds.

"Buck up! Cheer up! The fight isn't over," Scalia said.

LinkedIn Is Now Offering For Free What Facebook Wants Advertisers To Pay For (LNKD)

LinkedIn just rolled out its redesigned company pages to all advertisers, after a period in beta with a select group of companies, and announced a function that's a direct slap in the face of Facebook:

Free "featured updates" that persist within users' news feeds for up to 48 hours.

Facebook makes companies pay for those, and recently tweaked its algorithm to ensure that unpaid company posts are seen by even fewer users than ever. Agency clients have already started howling with frustration.

Thus LinkedIn is now offering for free what Facebook wants money for.

At the same time, the new company pages feature a large horizontal photo at the top of the page, just like Facebook's new Timeline format.

Of course, advertisers use LinkedIn for different purposes than Facebook. But still, the timing nonetheless underscores the way Facebook is making it harder for advertisers to get free exposure in its ecosystem.
