Mitt Romney Concedes Election To Obama

Mitt Romney conceded the presidential election Tuesday, telling supporters in Boston that he has called President Barack Obama to congratulate him on winning the rep-election. 

Romney's remarks were gracious and short, calling on lawmakers and job creators to look beyond political lines and solve the problems facing the country. 

"I believe in America. I believe in the people of America," Romney said. "This election is over but our principles endure." 

"Paul and I have left everything on the field. We have given our all to this campaign," he added. "I so wish that I had been able to fulfill your hopes to lead the country, but the nation chose another leader." 

Altogether, the speech clocked in at just under five minutes. And then he left the stage: 

"Thank you guys."

States Around The Nation Could Totally Change Their Schools Today

Chicago Teachers UnionAs millions of Americans head to the polls Tuesday, most of the attention will be on the tight presidential race.

But there are a number of ballot initiatives across the country that could significantly impact state education systems. Here’s a look at how voters could change policies on school choice, merit pay and more. Check back with The Hechinger Report after Election Day to find out the results.

Florida: A ballot initiative in Florida, if passed, will remove language from the state’s constitution that bans religious institutions from receiving taxpayer money. The measure does not explicitly reference education, but if it is successful, it will likely pave the way for private-school vouchers. While Florida currently has a voucher program for special education students and a tax credit scholarship program for low-income students, its statewide voucher program was ruled unconstitutional in 2006 because it gave taxpayer money to religious schools. If this language is removed, it seems likely vouchers could be reinstated.

Georgia: If Georgia voters approve a new constitutional amendment, the state will set up a special commission to authorize new charters. Such a commission existed until 2011, when the State Supreme Court ruled it unconstitutional. Now, local school boards must first approve charter school applications. If the State Board of Education follows suit, the school can open. If the local school board rejects the application, would-be charter operators can still appeal to the state. The Georgia Board of Education can approve the charter, but it will only receive state and federal money – not local property-tax funds.

If the amendment passes, the state commission would be able to grant charters, regardless of local board support. Opponents say the change will take money and control away from local school systems. Proponents argue it will increase school choice across the state.

Idaho: A slate of controversial education laws could be overturned in Idaho on Election Day. The state’s teachers union is leading the charge against three recently passed laws through propositions on the ballot.

Proposition 1 aims to repeal a law mandating that 50 percent of teacher evaluations be tied to student growth – an increasingly common policy nationwide. The law also abolished teacher tenure, limited collective bargaining and eliminated incentives for early retirement. Proposition 2 would end Idaho’s new merit pay plan, which provides bonuses for teachers and administrators based on student growth on standardized tests. The law also allows for bonuses to be given to teachers who take hard-to-staff positions or leadership roles. And if a majority vote yes on Proposition 3, a law mandating that all students take two online classes before graduating high school will be repealed.

Maryland: Voters in Maryland will decide if undocumented immigrants will be eligible for in-state tuition at public universities. The Maryland legislature passed its own version of a federal bill that has yet to pass, the Development, Relief and Education for Minors (DREAM) Act, last year, which allowed undocumented immigrants who have attended high school in the state and first attend a community college to receive in-state tuition prices at Maryland colleges and universities. Opponents have argued the measure will encourage illegal immigration, but it looks likely the law will remain on the books. A Washington Post poll found 60 percent of voters supported it.

Washington: Washington is one of nine states that don’t allow charter schools. That could change if a ballot initiative passes that would allow the schools to open across the state. Such a measure has been rejected three times in the past. If the vote goes the other way this time, though, 40 charters may be authorized in the state over the next five years. A parent trigger provision is also written into the ballot. A majority of parents, or teachers, could vote to convert their traditional public school into a charter if the initiative passes.

Jay-Z Raps '99 Problems (But Mitt Ain't One)' At Ohio Rally

Jay-Z and Beyoncé aren't just friends with the POTUS and FLOTUS, they are outspoken political supporters of the Obamas as well.

The musical power couple hosted an Obama fundraiser at their exclusive club in NYC over a month ago, and last night Jay-Z performed at an Obama rally in Cleveland.

Jay-Z sang a revised version of his hit song "99 Problems" by changing the lyrics to "If you're having world problems I feel bad for you son, I've got 99 problems but Mitt ain't one."

The rapper made it clear that he had not cleared the lyric change with the Obama camp, and joked that the Secret Service might tackle him.

Two Reports Identify The Trader Who May Have Cost Rochdale A Fortune On An Apple Trade Gone Bad

The New York Post and Bloomberg News have both identified the Rochdale trader who made unauthorized purchases of $1 billion in Apple stock last month as David Miller.  

We did a FINRA Broker Check to find out more on Miller.  FINRA records show that Miller had been with Rochdale since February 2009. 

Prior to that, he did stints and Ladenburg Thalmann (5/2008 to 2/2009), Punk, Ziegel & Co. (2/2004 to 5/2008), Assent LLC (5/2003 to 2/2004) and Needham & Co. (4/1997 to 2/2004), M.H. Meyerson (2/1996 to 4/1997) and Gilford Securities Inc. (1/1995 to 2/1996), the records show. 

He has no customer complaints against him, the records indicate.

However, following those improper purchases of Apple at Rochdale, the FBI, the SEC and FINRA are all probing the trader, according to the New York Post's Mark Decambre citing sources familiar.

In particular, the FBI is looking into an alleged stock manipulation scheme involving another trader from a different firm who has not been identified at this time.

According to reports, what happened at the 37-year-old Stamford-based brokerage firm was Miller bought 1.6 million Apple shares when he was supposed to buy just 160,000 for a client, the Post reported.  

Bloomberg TV's Stephanie Ruhle reported yesterday that those unauthorized stock purchases took place near Apple's earnings release on Oct. 25. Shares of Apple have dropped more than 4% since then.

According to the Post, Miller's $1 billion Apple trade was discovered and unwound in the same day.  He stopped going to work the next day. 

Miller has not been charged with any wrongdoing.  

Following the Apple trade, Rochdale, which employs noted bank analyst Dick Bove, is now looking for either a merger deal or a capital injection to stay afloat.

Obama And Geithner May Be Have The Power To Make The Fiscal Cliff Less Scary

Without question, one of the biggest uncertainties out there is the U.S. fiscal cliff.

Zachary Goldfarb at the Washington Post, writes that President Obama and Treasury Secretary Timothy Geithner may be able to spare this fragile economy from the ill effects of the cliff.

The government has a great deal of flexibility in how the sequestration cuts are made, he writes. By choosing to forego a large capital expenditure (for example, a new carrier) the government could avoid pay cuts or layoffs to affected employees. Experts expect that the Obama administration will postpone much of the sequestration cuts until the later part of 2013, sparing the economy from any immediate negative impact.

Goldfarb also explains that certain contingency plans have been in place since the administration last faced expiration of the Bush tax cuts:

In 2010, when taxpayers were about to see a similar automatic increase in income taxes, top advisers to Treasury Secretary Timothy F. Geithner privately concluded that he probably had the power to put off changes to the tables under some circumstances, according to sources who spoke on the condition of anonymity to discuss the previously unreported deliberations.

Geithner reportedly has the ability to set the amount in taxes withheld from a paycheck. Though he is supposed to comply with established law, he does have some latitude in the matter and could ‘freeze’ the amount taken out of paychecks at 2012 levels – in effect, delaying a tax increase. If no action is taken, the Tax Policy Center estimates that, on average, middle class families will be hit by a $2,000 tax increase. 

Freezing the withholding table would not be a permanent solution, but would buy Congress time to make a deal in the interim. 

Though these potential actions sound like the standard ‘kicking the can down the road’, it appears to mitigate the sense of urgency tied to the fiscal cliff, which  analysts at Bank of America Merrill Lynch project will spark a 4.6% decline in GDP, which would almost certainly throw the U.S. economy into recession during 2013.
